Abstract
The legislation enshrines a fundamental principle of criminal responsibility and criminal law, namely free will or the freedom of a person to choose the path of crime. It goes without saying that every person acts according to his or her own free will, provided that he or she is of sound mind and discernment and has no grounds for criminal irresponsibility.
In this article, the author attempts to highlight the jurisprudential and legislative foundation of free will as a basis for criminal liability, before examining the fact that the system of criminal liability is based on free will and the extent to which it is possible to maintain this system in its current form.
