The issue of family disintegration is one of the most prominentproblems that threaten the lives of spouses and the entirefamily. This scourge has invaded most classes of Iraqi society,and this is due to the rapid social and cultural change that oursociety has gone through, which led to an imbalance in thestructure and function of the family, which was followed by theoccurrence of tension and conflict between The couple endedup with family disintegration. The topic of familydisintegration has aroused the passion of many researchers invarious fields of science, social and psychological, but it hasbeen less interesting in the field of legal sciences. Although it isa social problem, it at the same time constitutes a legal problemthat needs to receive the attention of legal researchers, and topropose effective solutions in order to eliminate it or at leastreduce its high levels.
