The right to health is one of the fundamental human rights, as it is directly linked to the right to life and human dignity, and is crucial for achieving social justice and protecting citizens from health risks. This study focuses on the legal protection of the right to health in Iraq, by examining the constitutional foundations that guarantee this right, and analyzing the legislative applications and legal and judicial safeguards implemented in the health system. The research also highlights the legislative, institutional, economic, and social obstacles that limit the effectiveness of this right, and proposes practical mechanisms to strengthen legal protection and ensure effective implementation that balances legal provisions with practical realities, contributing to the development of health policies, enhancing the role of public law in safeguarding public health, and promoting health justice.
