The Iraqi government, represented by the Council of Ministers, plays a significant role in managing the state interests and setting its general policy, for this reason, the research addressed the mechanism of government formation, and the restrictions imposed on it by analyzing the relevant texts from the Republic of Iraq’s 2005 Constitution. The research focused on two types of procedural restrictions that clarify the mechanism of naming the Prime Minister and forming the ministry as well as temporal restrictions that refer to specific time periods for carrying out these procedures, and despite the existence of these restrictions, they lack explicit sanctions, which led to repeated political crises and constitutional voids.
