The Concept of Public Order in Civil Law

Abstract
The subject of public order is one of the important and complex subjects that the discussion is based on in the research circulating in private and public law, as it constitutes a set of necessary legal rules that aim to protect the public interest, and that the rules related to public order may not be agreed upon by individuals to violate them because they are related to the general foundations of society and because they aim to protect the basic principles in society, they express the spirit of the legal system on which the foundations of building society are based, whether social, economic or political, which gives the public order distinctive characteristics that ensure its existence and difference, as it determines the legal framework that individuals must respect in drafting and implementing contracts, thus ensuring the achievement of justice in contracting and protecting the rights of each party in accordance with public interests and public order, and preventing the contract from being exposed to invalidity, considering that the ruling on violating the rules of public order is invalidity, and this is what the Iraqi legislator decided in the texts of the laws.
